Terms of Service
Effective Date: May 12, 2026
These terms apply to Vendors using the Popgo platform to register for events. For Organiser-specific terms, please see our Organiser Terms of Use.
Welcome to Popgo. These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you", "Vendor") and Popgo.my ("we," "us" or "our"), concerning your access to and use of our platform for event booth registration and payment.
1. Acceptance of Terms
By accessing or using the Popgo platform, including registering for an event booth, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the service or complete a registration. You will be required to explicitly accept these Terms via a checkbox before completing any payment.
2. Platform Role & Liability
Popgo provides the technological infrastructure for event booth bookings and payments. We act as a technology facilitator between Event Organisers and Vendors. Popgo is not the organiser, host, or operator of any event listed on the platform. We assume no liability for the execution, quality, safety, or legality of any event. All disputes regarding event execution must be directed to the Event Organiser.
3. Service Fees
A non-refundable platform service fee of RM 5.00 is added to every transaction processed through Popgo. This fee covers platform maintenance, payment processing infrastructure, and technical support. This service fee is charged to the Vendor and is not refundable under any circumstances, including event cancellation, application rejection, or voluntary withdrawal.
4. Payment Processing & Finality
All payments are processed securely through Stripe, a PCI-DSS Level 1 compliant payment processor. Once a payment is completed:
- The booth reservation is considered binding.
- Funds are transferred directly to the Event Organiser's connected Stripe account. Popgo does not hold or escrow funds.
- Payment confirmation will be sent to the email address provided during registration.
- The payment amount is calculated server-side based on the booth type price and quantity selected. The amount displayed on the checkout page is verified against our database before processing.
5. Refund Policy
Refunds are managed as follows:
- Refund authority: Refunds are at the sole discretion of the Event Organiser. Popgo cannot independently issue refunds for booth payments.
- Application rejection: If your application is rejected by the Organiser, they may initiate a full refund (excluding the RM 5.00 service fee) through the Popgo dashboard.
- Processing time: Approved refunds take 3–5 business days to appear in your account, depending on your bank or payment provider.
- Non-refundable items: The RM 5.00 platform service fee is non-refundable. Stripe processing fees absorbed during the original transaction are not returned to the Vendor.
- Event cancellation: In the event of cancellation by the Organiser, refund obligations fall on the Organiser. Please refer to the event's specific cancellation policy.
6. Booth Reservation & Lock Window
When you select a booth on the checkout page:
- The selected booth(s) are temporarily reserved for you during checkout.
- You have a 5-minute window from the point of selection to complete payment. If payment is not completed within this window, the reservation is automatically released and made available to other vendors.
- Booth availability is shown in real-time. A booth marked as "available" at the time of your visit may become reserved by another vendor before you complete payment.
- We employ atomic reservation technology to prevent double-bookings. However, in rare edge cases, if a conflict is detected after payment, a full refund will be automatically issued.
7. Chargeback Policy
Vendors who initiate chargebacks through their bank or credit card provider without first contacting the Event Organiser to resolve the dispute may be permanently banned from the Popgo platform. If you have a legitimate dispute, please contact the Event Organiser directly or reach out to our support team at support@popgo.my. We will facilitate mediation where possible.
8. Vendor Obligations
By registering as a vendor through Popgo, you agree to:
- Provide accurate and truthful information during registration, including your brand name, contact details, and any required documentation.
- Abide by the individual rules and requirements set forth by the Event Organiser whose event you are joining.
- Not use automated tools, bots, or scripts to register for booths or manipulate availability.
- Not transfer, resell, or sublicense your booth reservation to a third party without the Organiser's written consent.
9. Data Usage & Consent
By registering through Popgo, you consent to the following:
- Your brand name, contact information, and uploaded media (photos, logos, documents) will be shared with the Event Organiser for event management purposes.
- Your registration data may be used by Popgo for platform analytics and service improvement, in accordance with our Privacy Policy.
- You may receive transactional communications (payment confirmations, approval/rejection notifications) via email or WhatsApp. You may opt out of non-essential communications at any time.
For full details on how we handle your personal data, please see our Privacy Policy, which complies with the Malaysian Personal Data Protection Act 2010 (PDPA).
10. Intellectual Property
The Popgo platform and its original content, features, and functionality are owned by Popgo and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You retain ownership of all content you upload (photos, logos, documents) but grant Popgo and the Event Organiser a non-exclusive license to use this content for event management purposes.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Popgo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to: loss of revenue, loss of business opportunities, event cancellations, or disputes with Event Organisers. Our total liability to you for any claim arising out of or related to these Terms shall not exceed the total amount of service fees paid by you to Popgo in the preceding 12 months.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
