Organiser Terms of Use

These terms apply to Event Organisers using the Popgo platform to manage events. For Vendor-specific terms, please see our Vendor Terms of Service.
These Organiser Terms of Use ("Organiser Terms") govern your use of the Popgo platform as an Event Organiser. By creating an account and publishing events on Popgo, you agree to these terms in their entirety.
1. Organiser's Duty of Care
As an Event Organiser on Popgo, you are responsible for:
- Providing accurate and truthful event information, including date, time, location, and booth specifications.
- Ensuring that the event complies with all applicable local laws and regulations, including permits, licenses, and safety requirements.
- Maintaining the quality and safety standards of the event venue.
- Misleading or fraudulent event details may result in immediate account suspension and withholding of pending payouts.
2. Payment & Stripe Connect
To receive vendor payments through Popgo:
- You must maintain an active Stripe Connect account linked to your Popgo profile.
- Vendor payments are transferred directly to your Stripe Connect balance, minus Stripe's processing fees.
- Popgo collects a separate RM 5.00 platform service fee per vendor registration. This fee is collected by Popgo and is not included in your payout.
- You are responsible for your own tax obligations related to booth rental income.
3. Refund Obligations
You hold sole authority and responsibility for vendor refunds:
- Application rejection: If you reject a vendor's application, you should initiate a refund through the Popgo dashboard within 7 business days.
- Event cancellation: If you cancel an event, you are obligated to issue full refunds to all paid vendors within 7 business days. Failure to issue timely refunds may result in Popgo initiating refunds from your Stripe Connect balance.
- Partial refunds: At your discretion, you may issue partial refunds for booth changes or downgrades. The RM 5.00 Popgo service fee remains non-refundable to the vendor.
4. Booth Delivery Guarantee
You must provide the booth type, size, and location as described at the time of vendor registration. If material changes are required (e.g., booth relocation, size adjustment), you must notify all affected vendors with reasonable advance notice and offer the option to withdraw with a full refund.
5. Pricing Integrity
Once a vendor has paid for a booth at a listed price, you cannot increase the price retroactively or charge additional unlisted fees through the Popgo platform. Price changes after publication only apply to new registrations. Existing paid registrations are honoured at the original price.
6. Communication Standards
- You must respond to vendor inquiries within 48 hours during the pre-event period.
- Bulk messaging tools provided by Popgo (email, WhatsApp) must be used exclusively for event-related communications. Unsolicited marketing, spam, or off-topic messaging is prohibited.
- All communications must be professional and respectful.
7. Event Cancellation Policy
In the event of cancellation, you must:
- Notify all registered vendors within 24 hours of the cancellation decision.
- Initiate refunds to all paid vendors within 7 business days.
- Update the event status on the Popgo platform to reflect the cancellation.
Failure to comply with these obligations may result in Popgo initiating automatic refunds from your Stripe Connect balance and/or suspension of your account.
8. Vendor Data Handling
Vendor data accessed through the Popgo dashboard:
- May only be used for event management purposes directly related to the event the vendor registered for.
- Must not be shared with third parties without the vendor's explicit consent.
- Must not be used for unsolicited marketing outside of the Popgo platform.
- Must be handled in compliance with the Malaysian Personal Data Protection Act 2010 (PDPA).
9. Dispute Resolution
Disputes between Organisers and Vendors must first be attempted through direct negotiation. If resolution cannot be reached, either party may request Popgo to act as a mediator. Popgo may facilitate communication between parties but is not liable for the outcome of disputes. Popgo reserves the right to freeze payouts during active dispute investigations.
10. Account Suspension & Termination
Popgo reserves the right to suspend or terminate your Organiser account if:
- You repeatedly fail to issue refunds for rejected applications or cancelled events.
- You provide misleading or fraudulent event information.
- You violate vendor data handling obligations.
- You receive multiple unresolved vendor complaints.
- You violate any other provision of these Organiser Terms.
11. Governing Law
These Organiser Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
